• The BeWe service is a commercial service provided by the company Melon Network Technology Sdn Bhd.
• When you join BeWe as a "member", you are subscribing to a service from Melon Network Technology Sdn Bhd, a privately owned organisation. The word "member" or "membership" refers to your subscription or your status as a subscriber to the service.
• This Membership Agreement, when signed by the applicant and accepted by [Melon Network Technology Sdn Bhd] constitutes a binding contract between [Melon Network Technology Sdn Bhd] and the individual or entity executing the signature page of this Agreement. Membership rights, privileges and obligations commence when the Agreement is signed by both parties as of [Agreement.Date].
• These terms and conditions form the basis of the contract through which BeWe will deliver the service. On subscribing you agree to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with the Personal Data Protection Act 2010 of Malaysia.
• BeWe or its agents store, host and otherwise process the information (including personal data) supplied by its members / subscribers / users via online or offline.
• The personal data you supply will be used to process your application for membership, application for services, newsletter or information subscription or your application to become a member.
• The data collected by BeWe through its website will be used for: marketing; statistical and analytical purposes; to improve its own web content; to develop new products and services and to administer membership.
• BeWe may monitor the usage of its website by members whilst respecting the privacy of its members. Additionally, BeWe makes member contact information available through its Membership Directory to other members using its website and to those who register for its conferences.
• Application forms for Applicants may be submitted online through the BeWe website or may be submitted to BeWe agents. The processing time of an application is no more than three (3) working days.
• You may not join BeWe (or create an account) unless you are 18 years of age or older, nor may you create an account on behalf of anyone who is under 18 years of age • Any under 18 of age sign up must be accompanied by a guardian signature and authorization.
• Selecting to purchase the Family package will entitle all members under said package to be a 2 star member upon approval.
• The family package is only available for 3 individuals and above and must be an immediate family member. Immediate family members are defined as : Parents, Siblings and Children only.
• Any corporate package purchase will entitle all members under said package to be a 2 start member upon approval
• If a member under the corporate package is terminated from the corporation or has resigned, the individual may opt to renew his/her membership individually and still retain their 2 star benefit.
• Corporate packages are only available with 10 members or more
• BeWe will consider the membership possibilities of Applicant. BeWe has the right to refuse Applicant to become a Member.
• Applicants for membership who as pre-existing conditions and/or illness be considered once all relevant supporting documentation is received by BeWe as outlined in the description of the respective membership.
• Membership type and levels are as stipulated in the CCL Table of these Terms and Conditions.
• BeWe reserves the right to change or modify or cancel the membership type of an existing Applicant, if the provided information is not received by BeWe, or proves to be inaccurate in any way. BeWe will inform Applicant on this matter.
• All information provided by Applicant to BeWe must be true and accurate at the point of applying. In the event of a change of circumstances such as moving jobs or change of contact details, Applicant shall notify BeWe in writing as soon as possible.
• It is the responsibility of all members to contribute Help Points to any case presented to them for their consideration. The amount if Help Points is up to the discretion of the members themselves
• The Membership shall take effect at the moment of approval of the Applicant by BeWe. BeWe membership is valid for 1 year.
• Members are not permitted to use BeWe logo and/or name or any of the marketing materials for the purpose of self-promotion on any of their organizational materials, including websites without a written consent from BeWe.
• Members are not permitted to use their Membership for self promotion.
• BeWe does not sell, trade, or rent out the personal data of Members to any third parties. BeWe may use generic aggregated demographic information which is not linked to any personal data regarding Members for internal purposes. BeWe may use third party service providers to help operate its business or administer activities on its behalf. BeWe may share said information with these third parties for those limited purposes.
• BeWe retains the right, without prior notification to individual members, to change the terms and conditions of its membership program. Any such changes will be published on the website and will enter into effect 14 days after these changes were announced, unless otherwise stipulated. Members are responsible for keeping informed about any changes to the membership terms and conditions.
• When changes are made to the membership terms and conditions that require legal consent or approval, the BeWe will ask its members for consent or approval. BeWe reserves the right to terminate membership of members who do not provide their consent or approval of the new terms and conditions. Members may terminate their membership agreement if they no longer wish to be tied to the changed terms and conditions.
• When signing a membership agreement to join BeWe, members are requested to consent to receiving information and notifications from BeWe via email and app notification. Members must give their consent to this in order to be eligible to join the membership program. Members are free to withdraw their consent any time by withdrawing themselves from BeWe the platform via email or through the website or app function.
• If members have provided their consent, the BeWe will send information and offers based on former transactions, and the information that members have provided. BeWe can thereby provide a better experience to those who have given their consent.
• Members can opt to choose the option of “full control? over their membership whereby they agree to adhere to the rules and guidelines set forth by BeWe, in the case of inactivity of 3 months, members who opted this option hereby do give consent to BeWe to utilize 50% of their available Health Points to be used to aid any available cases indiscriminately.
• Member consent is voluntary and can be changed any time. Consent can be managed under My Page, which can be accessed by logging in to our app or by visiting our website www.bewe.asia.
• Members can also provide their consent why contacting our Customer Service department via email at support@bewe.asia or by calling the customer service hotline which can be found on our website or on your membership card.
• BeWe reserves its right not to fulfill or to cancel a member application at anytime.If a member is accepted into BeWe membership and subsequently it turns out that any or all of the information they provided was misleading or false: BeWe reserves its right to revoke the membership with immediate effect, without the right of appeal.
• You may not join BeWe (or create an account) unless you are 18 years of age or older, nor may you create an account on behalf of anyone who is under 18 years of age.
• By joining BeWe or creating an account with us, you represent to us that: you meet the age restrictions described and: the information you have provided to us when registering is true, accurate, current and complete. You agree to maintain and promptly update this using the functionality provided through our website or the BeWe App to keep it true, accurate, current and complete.
• In general membership runs for 12 consecutive months from the date when a member has applied and their application has been approved.
• A member of BeWe who has subscribed to BeWe membership can cancel their membership anytime by contacting BeWe via Customer Service department via email at support@bewe.asia or calling the customer service hotline which can be found on our website or on your membership card.
• Members who cancel their membership will be removed from membership with effect from the date on which their resignation is received by BeWe and all their member benefits and rights cease at that time. • Members who cancel their membership during the duration past the grace period of their membership period is not entitled to a refund of any paid fees.
• Members who do not renew their membership after the duration of their membership shall be removed from the platform and kept as inactive member for a period of 6 months and their accounts terminated with all star benefits revoked. The same member would be required to resubmit a new applicant to rejoin BeWe.(check PDPA and GDPR rules)
• BeWe Members will abide by the code of conduct hence set forth by the BeWe committee.
• This agreement shall remain in effect until one or more of the following occur:
- Member fails to meet any requirements of membership as stipulated in the Terms and Conditions.
- Agreement term lapses without further terms or agreements added.
- Company files for bankruptcy or ceases to do business under Melon Network Technology Sdn Bhd.
• All funds collected shall be kept in a trustee fund held by a registered Bank (hereby referred to as “Fund Pool 1? which will serve as the funds available to contribute via Help Points into financial assistance for member.
• Any fund not utilized by the end of the fiscal year shall be transferred to a secondary trustee fund (Hereby referred to as “Fund Pool 2? and shall be utilized by committee approved events and assistance to for member).
• Upon joining, all members shall be notified of a 30 day cooling off period to retract their membership and receive a full refund.
• All Help Points is subjected to a monthly limit set at 8% for contributions.
LIABILITY
• BeWe liability to its members will not extend to any membership related benefits, goods or services provided by an external provider. BeWe specifically excludes liability for any loss or damage suffered by a member as a result of her/his involvement in whatever manner with an external provider.
• Reasonable effort is made to ensure the accuracy of information provided on our websites, in newsletters, and any other publications; however, neither we nor the authors can accept liability for errors and omissions within its publications.
• The BeWe website may contain links to other websites, which in turn may contain material that has been produced by third parties not affiliated with us. We have no control over those other websites and accept no responsibility or liability for information or content provided on such websites.
• Even if data encryption is used, the security of information transmitted via the internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by electronic means shall be borne solely and exclusively by such user and in no event shall any such losses in whole or in part be borne by us.
• You may not broadcast, copy, download, frame, reproduce, republish, post, transmit or otherwise use our websites content appearing on our website, or any other media, in any way except for your own personal, non-commercial use. Any other use of such content requires permission of our company.
• You agree only to use our website, and associated services for completely lawful purposes, in a way that does not infringe the rights of, restrict or inhibit the use or enjoyment of this site by any third party. Prohibited behavior includes but is not limited to defamation, damaging the security of our website, harassing or causing distress or inconvenience to any person, damaging content on our website, transmitting obscene or offensive content or anything which may affect the effective operation of our website.
• We reaffirm, hacking, damaging or otherwise compromising the security of this website is highly unlawful under Malaysian law, and hence will be treated as criminal damage in a Malaysian Court of Law. INDEMNITY
• The undersigned agrees to indemnify and hold harmless the Company, its officers and directors, employees and its affiliates and their respective successors and assigns and each other person, if any, who controls any thereof, against any loss, liability, claim, damage and expense whatsoever (including, but not limited to, any and all expenses whatsoever reasonably incurred in investigating, preparing or defending against any litigation commenced or threatened or any claim whatsoever) arising out of or based upon any false representation or warranty or breach or failure by the undersigned to comply with any covenant or agreement made by the undersigned herein or in any other document furnished by the undersigned to any of the foregoing in connection with this transaction.
• Should BeWe have to be discontinued due to conditions pertaining to a country’s legislation, a court decision or a prohibition by a country’s public authorities, BeWe will not be held responsible for any losses to the individual member that may ensue from this termination. BeWe will, as far as possible, attempt to inform individual members as soon as possible if the circumstances described under this point should arise, and pay each discontinued member an equal share from the remaining fund pool.
